Medical Marijuana Dispensary

The City of Bessemer City Council is reopening a public hearing regarding
a special use permit for a Medical Marijuana dispensary in the city's
industrial zoned district. During the December 16, 2013 City Council
meeting, a few citizens appeared and complained that the public hearing
held on December 2, 2013, had not been properly advertised in the local
At the December 2, 2013 hearing, the City Council heard the presentation of Mr. Richard Duncanson, who applied for a special use permit to operate a medical marijuana dispensary in the industrial zoned district. Mr. Duncanson's application was made under a 2011 city ordinance that specifically outlined security requirements to operate such a business in the City of Bessemer. When the ordinance was adopted in April 2011, there was no public objection and the ordinance was adopted by a 5-0 vote.
After the December 2, 2013 hearing, a divided City Council granted Mr. Duncanson a special use permit on a 3-2 vote.
However, after the December 16, 2013 objections were heard, the file was reviewed and it was found that notice of the December 2, 2013 hearing was posted but had not been published in the local paper. In order to meet all posting requirements and give all citizens a chance to be heard, the City Council is reopening the permit process for reconsideration at a February 3, 2013 public hearing.
City Manager Michael Uskiewicz observed that many people were unaware the City Council adopted a model medical marijuana dispensary ordinance in Apri of 2011, in response to the passage of the Michigan Medical Marijuana Act of 2008.
As well as hearing testimony at the February 3, 2014 hearing, the City Council is inviting public input in writing. Anyone wishing to file a written response to the permit should submit their responses to the City Clerk by January 30, 2014.
